Terms and Conditions relating to the use of our website are outlined here.

Access to this website is conditional upon your acceptance of and compliance with the terms, conditions, notices and disclaimers contained in this document (known as "Terms and Conditions"). Your use of, and/or access to, the site constitutes your agreement to the Terms and Conditions.

Pollna reserves the right to amend the Terms and Conditions at any time. We recommend you review these terms regularly, particularly before renewing your subscription or purchasing additional services. Since you are bound by these Terms and Conditions, you should periodically refer to them in this document and elsewhere on the site. Material changes will be notified via email to active subscribers.

Service Subscription and Cancellation
By agreeing to a Pollna website's build, you authorise the immediate commencement of direct debit payments at your selected service tier. Your first payment will be processed upon acceptance of these terms and represents your first month of service, during which your website will be built and launched. This initial payment is non-refundable once website development begins.

Monthly subscription charges continue regardless of whether your website is live, under review, or awaiting your feedback. If we provide you with website proofs, designs, or content for review and you delay in providing feedback or approval, monthly payments will continue to be processed as scheduled. These payments are non-refundable, as we are reserving resources and providing the service as agreed. Extended delays in client feedback do not pause or reduce subscription charges. It is your responsibility to review and respond to proofs in a timely manner to ensure your website goes live promptly.

You can use the website we build and host for you as part of the Pollna service, a subscription-based platform. The website remains on the Pollna platform and cannot be transferred, exported, or migrated to another provider or hosting service. You are subscribing to our complete service, which includes the website, hosting, maintenance, and support as an integrated package.

After your first month of service, you may cancel your subscription at any time by providing 30 days' written notice to hi@pollna.ie. During this 30-day notice period, you will continue to have full access to your website and services, with your final payment covering this period. Upon cancellation, your website will be taken offline, and you will lose access to all Pollna services. Should you wish to reactivate your website in the future, a new setup process and potential reactivation fee may apply.

For customers who purchase additional one-time packages or upgrades, these fees are separate from your monthly subscription and are non-refundable once the additional features have been implemented. These fees cover expanded website infrastructure and features and are not subject to the monthly cancellation terms.

Domain Name Services
If you have an existing domain name, we will assist you in pointing it to your new Pollna website at no additional charge. If you do not have a domain name, we can register one on your behalf. Domain registration fees are separate from your Pollna subscription and are charged annually at the point of registration or renewal. These domain fees will be added to your account and must be paid in full when due.

While Pollna manages your domain during your subscription, the name remains your property. Upon cancellation of your Pollna subscription, we will provide you with the necessary transfer codes and assistance to move your domain to a registrar of your choice. You are responsible for initiating this transfer within 30 days of cancellation, after which we are not obligated to maintain the domain registration.

Important: Domain names are renewed automatically on an annual basis to ensure continuity of your online presence. If you cancel your Pollna subscription shortly after we have renewed your domain for another 12-month period, you remain liable for the full annual domain renewal fee. This fee is non-refundable, as we have already paid the domain registrar for the full year. We recommend reviewing your domain renewal date before submitting your cancellation notice to avoid renewal charges.

Failed Payments and Administrative Fees
If your direct debit payment fails for any reason (including but not limited to insufficient funds, cancelled mandate, closed account, or invalid account details), an administrative fee of €29 + VAT will be charged to your account. This fee covers bank charges incurred by Pollna, administrative costs, and the time required to resolve payment issues.

Upon notification of a failed payment:

• You will be contacted immediately via email and given 7 days to establish a new payment method
• Your website will remain active during this 7-day grace period
• If payment is not resolved within 7 days, your website will be temporarily suspended
• If payment remains unresolved after 14 days, your website may be permanently removed and your account terminated

For accounts with repeated payment failures:

• First failed payment: €29 + VAT fee, 7-day grace period
• Second failed payment within 6 months: €49 + VAT fee, immediate suspension, 7 days to resolve
• Third failed payment within 6 months: €69 + VAT fee, account subject to immediate termination

You are responsible for ensuring your payment details are current and that sufficient funds are available for scheduled payments. This includes monthly subscription fees and annual domain renewals.

Pollna will notify you via email 30-60 days before processing annual domain renewal charges to allow you adequate time to prepare for this payment. However, failure to receive or read these notifications does not waive your payment obligations or associated fees for failed payments. It remains your responsibility to ensure payment details are valid and funds are available when charges are processed.

Copyright & Trademarks
Intellectual property rights and restrictions on the use of content on the site. All information, text, material, graphics and advertisements on the Site (“Content”) are Copyright © Pollna its suppliers and/or licensors unless expressly indicated otherwise on the Site.

You must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit, or distribute this content in any way except as expressly provided on the site or specifically authorised in writing by Pollna. Strictly on the condition that you keep all content intact and in the same form as presented on the site (including, without limitation, all copyright, trademark and other proprietary notices and all advertisements), you may:

• using an industry-standard Web browser, download and view the Content for your personal, non-commercial use, or
• If you are an Internet service and/or access provider, supply the content to your subscriber.

You must not use the Site in any way that is unlawful, violates any rights of Pollna, or contradicts the Terms of Use.

Service Scope and Limitations
The Pollna Starter package includes a maximum of 5 pages with up to 7 content sections per page and 500 words per page. Professional packages include up to 15 pages with expanded content limits. Any requests beyond these specifications require additional fees or package upgrades. 

One round of revisions is included with up to 5 specific changes. Additional revision rounds or changes are charged at our current hourly rate. Clients must provide all content, images, and feedback within specified timeframes or accept the website as designed.

Content and Materials
You warrant that all materials, text, images, and content you provide for your website are either owned by you or properly licensed for use. You indemnify Pollna against any claims arising from copyright infringement, defamation, or other legal issues related to your content. Pollna reserves the right to refuse to publish content that may be illegal, defamatory, offensive, or in violation of third-party rights. Stock images or content created by Pollna remain licensed for use only while your subscription is active.

Acceptable Use Policy
Prohibited Uses: Websites hosted on Pollna may not be used for illegal activities, adult content, gambling (unless properly licensed), hate speech, malware distribution, copyright infringement, or any activity that could damage Pollna's reputation or infrastructure. Violation results in immediate termination without refund.

Resource usage must remain within reasonable limits. Excessive bandwidth, storage, or server resources may incur additional charges or require package upgrades.

Service Level and Support
Support is provided during normal business hours (9am-5pm Irish time, Monday-Friday). Emergency support outside these hours may incur additional charges. Support covers technical issues with the Pollna platform but does not include training, content creation (unless part of your package), or third-party integrations.

While we strive for 99.9% uptime, occasional maintenance is required. Plans for maintenance will be notified in advance when possible. No service credits are provided for downtime.

Data Protection and Privacy
Data Protection: Pollna acts as a data processor for any personal data collected through your website. You remain the data controller and are responsible for compliance with GDPR and data protection laws. A separate Data Processing Agreement is available upon request.

We maintain appropriate security measures but cannot guarantee absolute security. You are responsible for maintaining backups of critical content and accept the risk of potential data loss.

Modification of Services
Service Changes: Pollna reserves the right to modify features, pricing, or service offerings with 30 days' notice for existing customers. Price increases will not exceed 20% annually. If changes materially reduce service levels, you may cancel without penalty.

Dispute Resolution
Disputes and Governing Law: Any disputes will first be addressed through good faith negotiation. If unresolved within 30 days, disputes may be submitted to mediation in County Kerry, Ireland. Legal proceedings, if necessary, will be conducted exclusively in Irish courts.

Trademarks of Pollna
All trademarks displayed on the site are trademarks of Pollna or their respective owners. Nothing contained on the Site should be construed as granting any licence or right of use of any trademark displayed on the Site without the express written permission of Pollna or a third-party owner.

Links
The site contains hyperlinks and other pointers to Internet websites operated by third parties. These linked websites are not under the control of Pollna, and Pollna is not responsible for the contents of any linked website or any hyperlink contained in a linked website. Pollna provides these hyperlinks to you as a convenience only, and the inclusion of any link does not imply any endorsement of the linked website by Pollna.

Limitation of Liability
Under no circumstances (including but not limited to any act or omission on the part of Pollna) will Pollna be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use of or access to, or any inability to use or access, the Site or any Content. You expressly acknowledge and agree that Pollna does not exert control over users of the Site (including individuals referred to on the Site as guests and experts) and is not liable either for their opinions or their behaviour, including any information and advice and any defamatory statements or offensive conduct.

Payments
You are liable for all transactions carried out by you or by anyone carrying out a transaction with your authority or express or implied consent, regardless of when the transaction is processed to your account. You should check your statements and records carefully. If you believe a transaction is wrong or unauthorised, you should contact us immediately.

Email Communication
You agree to receive service-related emails from Pollna including payment confirmations, service updates, and important notices. It is your responsibility to maintain a valid email address and ensure our emails are not blocked by spam filters. Failure to receive or read email communications does not waive your obligations under these terms.

Marketing emails are separate from service emails, and you may opt out of marketing while still receiving essential service communications.

Termination by Pollna
Pollna reserves the right to terminate services immediately for violation of these terms, non-payment, or behaviour deemed harmful to our business or other clients. In such cases, no refunds will be provided, and websites will be removed immediately.

Website Availability and Warranties
We will make all reasonable effort to ensure that the Site is available 24 hours a day, seven days a week. However, electronic services are subject to interruption or breakdown, and we cannot guarantee uninterrupted access.

The Pollna service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. 

While we strive for 99.9% uptime, occasional maintenance is required. Planned maintenance will be notified in advance when possible. No service credits or refunds are provided for downtime. You acknowledge that temporary interruptions may occur and accept this risk as part of using an online service.

We do not warrant that the website will achieve any specific results for your business, including but not limited to increased sales, customer engagement, or search engine rankings.

Price Protection for Existing Customers
Existing customers are protected from price increases for 12 months from their start date. After this period, the 20% annual cap applies.

Age Requirement
You must be at least 18 years old and have the legal authority to enter into contracts to use Pollna services. If you are signing on behalf of a business, you confirm that you have the authority to bind that business to these terms..

Client Responsibilities and Timeline
Failure to provide required content, feedback, or approvals within 14 days of request may result in the website being launched as designed. Projects requiring client content or approval that remain inactive for 30 days will be launched as-is or closed at Pollna's discretion. Projects delayed beyond 60 days due to client inaction will be permanently closed and require a new setup fee to restart. Reactivation of closed projects is subject to availability and current pricing.

SEO Disclaimer
While Pollna websites are built with SEO best practices, we cannot guarantee specific search engine rankings or timeframes for visibility. SEO is affected by numerous factors outside our control, including competition, algorithm changes, and content quality.

Third-Party Services
Pollna is not responsible for changes, failures, or fees related to third-party services you choose to integrate (payment processors, booking systems, social media feeds, etc.). Support for third-party tools is limited to initial setup guidance only.

Refund Policy
Monthly subscription fees are non-refundable. One-time setup fees, Professional Package fees, and domain registration fees are non-refundable once work has commenced or services have been purchased. No partial month refunds are provided upon cancellation.

Other
This agreement will be governed by and construed in accordance with the laws of Ireland. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement, which will continue in full force and effect. All rights not expressly granted herein are reserved.
